The Mayors Council:
- appoints the Commissioner and up to two Deputies as independent statutory officers;
- fixes their remuneration;
- must not terminate their appointment*; and
- must not change their remuneration without their consent. Note that the cost of running the Commission is paid by TransLink. Here is a link to the Commission’s annual budget submissions.
A Commissioner or Deputy must declare a conflict of interest (e.g. though involvement in a business such as taxi, trucking, independent transit or parking), and then either remove the conflict or resign.
Their appointment is:
- for six years (to April 30, 2013 in the case of the first Commissioner);
- terminated if the Commissioner or Deputy:
- resigns; or is
- found to be incapable of managing the his or her own affairs by reason of mental infirmity;
- removed by the Supreme Court due to conflict of interest; or
- found by the Supreme Court to be in material breach of his or her duties or obligations.
*the Council may, however, by 3/4 majority vote, terminate a Commissioner’s appointment for cause. e.g. where he or she is found guilty of serious misconduct, habitual neglect of duty, incompetence, or conduct incompatible with his or her duties.
